New Changes to the Penal Code of Greece: An Overview of Significant Changes
The new Penal Code of Greece brings a series of significant changes that affect criminal justice and the way various crimes are handled. Through the following ten changes, the new legal framework seeks to achieve a fairer and more effective management of the criminal system.
- Misdemeanors: Suspension of Imprisonment: The change in the penal regime provides for the suspension of imprisonment for misdemeanors up to one year, subject to compliance with specific conditions. Additionally, a sentence of 30 days to six months is provided for imprisonment up to three years, while for sentences from three to five years, imprisonment ranging from 1/5 to 2/5 of the sentence is envisaged.
- Felonies: Increased Penalties: The maximum limit of temporary imprisonment is increased for certain felonies, while stricter penalties are provided for convicts.
- Ex Officio Prosecution: There are changes in offenses of a criminal nature, allowing ex officio prosecution without prior criminal complaint.
- Domestic Violence: Obligation to Report: The obligation of professionals to report cases of domestic violence is legislated, providing protection to them from malicious lawsuits or adverse treatment.
- Arson: Stricter Penalties: Stricter penalties are introduced for the crime of arson, especially when it has serious consequences such as death or serious bodily harm.
- Seizure in Case of Arson: The seizure of assets of those convicted of the crime of arson in forests is established.
- Dangerous Driving: Stricter Sanctions: Stricter sanctions are imposed for dangerous driving, especially when it causes death or serious bodily harm.
- Special Crimes: New Crimes Against Hospitals and Schools: The crime of disrupting the operation of hospitals and schools is established, with stricter penalties for offenders.
- Liability of Legal Entities: Legal entities involved in bribery are subject to strict sanctions.
- Increase of the Minimum Penalty for Manslaughter by Negligence: The prison sentence for manslaughter by negligence is increased, creating a stricter legal framework for this offense.
